HAWAIIAN GARDENS, CA – The City of Hawaiian Gardens issued an emergency order in response to the COVID-19 crisis on Wednesday, March 25, 2020. The stipulations of the order include the closure of City facilities, suspending the issuance of parking citations and late penalties for City fines, setting price-gouging protections and placing a temporary moratorium on residential and commercial evictions related to the COVID-19 crisis.

City Manager Ernie Hernandez, in his role as the Director of Emergency Services for the City, issued this order in keeping with guidance and emergency declarations from federal, state and local authorities.

“The closures we’ve implemented as a City were made in order to protect our residents,” Hernandez said. “I want to stress the importance of maintaining social distance and abiding by the State and County mandates regarding self-isolation. We understand that it’s difficult to change our daily routines so drastically, but the sooner we follow these mandates, the sooner life can return to normal.”

The City’s emergency order mandates the following:

• Closure of City facilities: All City facilities and the City’s skate park will be closed. Use of all playground and fitness equipment is prohibited, although residents practicing social distancing may still use public parks for the time being. Essential City services will continue, including: police and fire services, public safety, modified senior lunch services and wellness checks for senior residents.

• Suspension of late fees and certain parking citations: The City has suspended late penalties for City-issued fines and charges and has stopped issuing citations and enforcement for street sweeping parking violations.

• Price gouging protections: Additionally, in keeping with state law, the City emphasizes that any person or business in the City of Hawaiian Gardens may not sell or offer consumer food items or other goods and services for a price more than 10 percent greater than the price charged immediately before the City Council proclaimed a Local State of Emergency on March 16, 2020. This policy will remain in effect for 30 days following the State of Emergency and may be extended for additional 30-day periods by the Council as appropriate.

• Eviction moratorium (residential and commercial): The order implements a temporary moratorium on evictions for non-payment of rent by residential and commercial tenants impacted by the COVID-19 crisis. Tenants unable to pay rent must notify landlords within 30 days after rent is due regarding their inability to pay related to COVID-19 and provide appropriate documentation. Tenants must repay unpaid rent within six months after the end of the local emergency, and landlords are not permitted to charge late fees for rent delayed due to COVID-19. Additionally, the City ordered a temporary suspension on residential foreclosures, requiring mortgagors to pay what they owe within six months of the expiration of the Local State of Emergency. The order urges mortgagees to offer payment plans to mortgagors to avoid foreclosures.
